Federal law on the Wi-Fi in Russia

Initially, the Wi-Fi technology was focused on organization of access points to the Internet for mobile users. This technology provides access to the Internet for subscribers especially in public places. Gradually Wi-Fi network has spread to large and small offices to corporate networks or subnets.

The advantages of wireless access are obvious and Wi-Fi technology has become the de facto standard among manufacturers of devices. Almost any modern mobile and multimedia devices have a useful function, such as Wi-Fi, but unfortunately, public Wi-Fi can be a dangerous tool in the hands of criminals.

The legislation of the Russian Federation

May 28, 2015 on the Federal portal of projects of normative legal acts of the Russian Federation was published the draft law prepared by the Ministry of communications and mass communications of the Russian Federation on amendments to the Federal law "On communications" and the Code of administrative offences (Cao), which proposed to establish administrative liability for legal entities and individual entrepreneurs for organizing a public Wi-Fi networks that did not provide user identification and user equipment.

Penalties and liabilities

According to this document, the penalties for individual entrepreneurs should be from five thousand to fifty thousand rubles for legal entities - from one hundred thousand to two hundred thousand roubles. Repeated violation of the law by individual entrepreneurs will result in a fine from ten thousand to hundred thousand roubles or disqualification for the term up to three years, while legal persons - a fine from two hundred thousand to three hundred thousand rubles.

The bill, which was developed in the Ministry of communications of Russia jointly with the Ministry of internal Affairs of Russia, FSB of Russia and the Ministry of economic development proposes to oblige all legal entities and individual entrepreneurs to provide free Internet access in public areas only if there is an agreement with your service provider about the user authentication. For violation of the procedure of identification, it is proposed to establish administrative responsibility, beginning with the first quarter of 2016.

Changes in Federal law

Changes in the Federal law "On communication", which relate to mandatory identification of users of public Wi-Fi networkshave been adopted in the framework of the implementation of the law No. 97-FZ of 5 may 2014 "On amending the Federal law "On information, information technologies and about information protection" and certain legislative acts of the Russian Federation on streamlining the exchange of information using information and telecommunication networks".

Identification methods

The RF Government resolution №758 from 31 July 2014 and No. 801 , dated August 12, 2014 has extended the same opportunities for the identification of subscribers of public networks. As a result, the operators had the opportunity to use to identify not only the passport of the citizen, or the mobile phone number, but to identify it with the help of data ESIA (Unified system of identification and authentication) or using the login and password on the website of the state services of the Russian Federation.
